A protection order is a legal directive issued by a court to prevent further acts of domestic violence. Here’s an overview of protection orders as described in the legislations of Sindh, Punjab, Balochistan, and Khyber Pakhtunkhwa (KPK):

 

Sindh

 

Under the Domestic Violence (Prevention and Protection) Act, 2013, a protection order can be issued if the court is satisfied that domestic violence has occurred or is likely to occur. This order can include prohibitions on contacting or approaching the victim, entering their place of employment, and causing violence to other family members. It aims to ensure the safety and protection of the victim from further abuse  .

 

Punjab

 

The Punjab Protection of Women Against Violence Act, 2016 outlines that if the court is convinced that violence has been committed or is likely to be committed, it may issue a protection order. This order can direct the defendant to refrain from communication with the victim, stay away from the victim, and surrender any weapons. Additionally, the order can include provisions for monitoring the defendant’s actions through electronic devices like GPS trackers  .

 

Balochistan

 

According to the Balochistan Domestic Violence (Prevention and Protection) Act, 2014, a protection order can be issued to safeguard the aggrieved person from further domestic violence. The order can mandate the accused to stay away from the victim, prohibit any form of communication, and prevent them from entering the victim’s residence or workplace. Violating a protection order is considered a serious offense and is punishable by imprisonment and fines  .

 

Khyber Pakhtunkhwa (KPK)

 

In KPK, the Domestic Violence (Prevention and Protection) Act, 2021 also provides for the issuance of protection orders. These orders serve to protect the victim from further abuse by imposing restrictions on the abuser’s movements and actions. The court may direct the accused to refrain from committing any act of domestic violence, remove themselves from the shared residence, and not contact the victim directly or indirectly  .

 

General Provisions Across Provinces

 

Duration and Alteration: Protection orders remain in force until the court discharges them. The court can modify or revoke the order if there is a change in circumstances.

 

Breach of Protection Order: Violating a protection order is a punishable offense. Penalties include imprisonment and fines, which are intended to enforce compliance and protect the victim.

 

These provisions aim to provide immediate and effective relief to victims of domestic violence, ensuring their safety and well-being through legal protection and enforcement measures.
